Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Parlar application (“Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not download or use the Service.

These Terms constitute a legally binding agreement between you and Parlar. We reserve the right to update these Terms at any time. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

2. Description of Service

Parlar is a real-time multilingual communication platform that enables voice and video calls with live AI-powered language translation (“Dubbing”), live captioning (“CC”), text messaging with translation, call scheduling, contact management, and ephemeral media sharing (“Moments”).

Translation and dubbing are powered by third-party AI models and are provided on a best-effort basis. Translation accuracy, call quality, and dubbing fidelity may vary based on factors outside our control, including but not limited to: background noise levels, microphone quality, network conditions, speaker accent, speech clarity, and the availability of third-party AI services. You should not rely on the Service for critical, legal, medical, safety-related, or any communications where translation accuracy is essential.

3. Account Registration

You must create an account to use the Service. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your login credentials confidential and not share them with others
  • Notify us immediately of any unauthorized access to your account
  • Be solely responsible for all activity that occurs under your account
  • Not create accounts for others without their express consent

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to create an account. If you are between 13 and 18, you represent that you have your parent or guardian's consent to use the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Transmit unlawful, harassing, abusive, defamatory, threatening, or fraudulent content
  • Violate any applicable local, national, or international law or regulation
  • Record calls without the knowledge and consent of all parties (where required by law)
  • Attempt to reverse-engineer, decompile, disassemble, or create derivative works of the Service
  • Circumvent, disable, or interfere with usage limits, subscription restrictions, or security features
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use automated scripts, bots, or other means to access or scrape the Service
  • Attempt to gain unauthorized access to another user's account or our systems
  • Upload malware, viruses, or other harmful code
  • Use the Service in any way that could damage, overload, or impair our infrastructure

Parlar reserves the right to investigate and take appropriate action against anyone who violates this section, including removing content, suspending accounts, and reporting to law enforcement.

5. Subscriptions and Billing

The Service offers free trial and paid subscription plans. Paid plans are billed monthly or annually. Payments are processed through Stripe (web and Android) or Apple's in-app purchase system (iOS), depending on your device and payment method.

Subscription fees are charged in advance and are generally non-refundable except where required by applicable law. For purchases made through Apple, Apple's refund policies apply and refund requests must be directed to Apple. Free trial periods automatically convert to paid subscriptions at the end of the trial unless cancelled before the trial expires.

We reserve the right to change subscription prices with reasonable prior notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.

Dubbing minutes and caption minutes are consumed based on active usage and are allocated per billing period. Unused minutes do not carry over. The “My Voice” feature consumes dubbing minutes at 1.5× the standard rate when active.

6. Voice Cloning (My Voice)

The “My Voice” feature uses voice synthesis technology to produce speech in your voice for use in translated calls. By recording and submitting a voice sample, you:

  • Provide explicit consent to the processing of your biometric voice data for cloning purposes
  • Confirm that the voice sample is your own and that you have full rights to submit it
  • Understand that your cloned voice will be used to synthesize dubbed audio heard by other call participants
  • Acknowledge that voice data is transmitted to and processed by our voice synthesis provider under their terms and privacy policy

You may delete your voice profile at any time from your account settings. Upon deletion, we will request removal of your voice model from our provider's systems. Complete deletion from all systems may take up to 30 days.

You must not submit voice samples of other people without their explicit written consent. Doing so is a violation of these Terms and may constitute a violation of applicable law.

7. Content and User Data

You retain ownership of content you create and share through the Service, including messages, media, and profile information. By using the Service, you grant Parlar a limited, non-exclusive, royalty-free licence to store, process, and transmit your content solely as necessary to provide and improve the Service.

You are solely responsible for the content you share. Parlar does not endorse any user-generated content and accepts no liability for content submitted by users.

8. Third-Party Services

The Service integrates third-party technologies to provide translation, voice synthesis, real-time communication, and payment processing. Parlar is not responsible for the availability, accuracy, or performance of these third-party services. Outages or degradation of third-party services may affect the availability or quality of features including translation, dubbing, captions, payments, and call routing.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Intellectual Property

The Service, including all software, designs, trademarks, and content created by Parlar, is owned by Parlar and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

11. Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, unplanned outages, force majeure events, or third-party service failures. Parlar shall not be liable for any loss or damage resulting from service interruptions.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARLAR EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Parlar does not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) AI-generated translations or voice output will be accurate, complete, or suitable for any particular purpose; or (d) call quality will meet any specific standard.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARLAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL PARLAR'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PARLAR IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

14. Indemnification

You agree to indemnify, defend, and hold harmless Parlar and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit to the Service.

15. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

You may close your account at any time through your profile settings. Closing your account does not entitle you to a refund of any unused subscription period.

16. Dispute Resolution

You agree to resolve any dispute with Parlar through binding individual arbitration rather than in court, except that either party may bring claims in small claims court. You waive any right to participate in a class action lawsuit or class-wide arbitration. This dispute resolution provision is governed by the Federal Arbitration Act.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Subject to the arbitration clause above, you consent to the exclusive jurisdiction of courts located in Delaware for any disputes not subject to arbitration.

18. Force Majeure

Parlar shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, natural disasters, pandemics, or failures of third-party infrastructure or internet services.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Parlar with respect to the Service.
